How the Lokpal will be Setup Essay

This is the latest draft ; which was submitted by UPA (United Progressive Alliance) government on 23 Dec 2011. On these draft basis the bill submitted in Loksabha with few modification on 27 Dec 2011 with the help of open voting in the Lok Sabha the bill was passed. The bill sent to Rajya sabha on the next day to get passed. But UPA has no majority in Rajyasabha that is why the bill could not be passed. What ever may be the case the Congress party have given a transparent way of voting on the bill. It is a great achievement of Indian constitution  and an example of transparency in the system. How the Lokpal will be setup:
*Lokpal chairperson and eight members will be appointed by a selection panel comprising the Prime Minister, 

*Lok Sabha Speaker, Leader of the opposition, Chief Justice of India or a judge nominated by him and an eminent jurist to be nominated by the President.

*The selection panel will get the names of nominees for lokpal from a search committee.

*The term of the Lokpal chairperson and members will be 5 years.

How Lokpal will function:
*After receiving a complaint against any public servant, the Lokpal will decide whether it merits a preliminary inquiry.

*Lokpal's  inquiry wing will submit a report within 60 days on its preliminary inquiry.

*A three member Lokpal bench will then decide whether to ask any probe agency (CBI) to register a case and proceed against the public servant.

Lokpal Latest Draft note Essay

December 20, 2011
Prime Minister of India Manmohan Singh cleared the Lokpal draft on Tuesday , 20 Dec 2011.
According to this bill anti-corruption body can supervise only those cases of corruption that are referred to it.
It was not according to Anna Hazare demand.
Main points of draft:
1. PM, Leader of opposition and the Chief Justice of India will choose the Lokpal. Proceeding to remove the Lokpal can be initiated if 100 MP back it.
2. CBI will report back only those cases of corruption to Lokpal that are referred to it by the anti-corruption body.
3. Lokpal can not investigate suo moto on complaints. The anti-graft body will also have 50% reservation for SC, ST and OBC.

Highlights of govt's Position on Lokpal Essay

PM under Lokpal with heavy safeguard: Decision on foreign policy and security not to come under scanner.

Citizens Charter: Bill will be moved with lokpal bill. Final authority on complaints will be under lokpal.

CBI: Special procedure to appoint director, other top officers to give it more autonomy. An independent directorate of prosecution to be set up.

Lower Bureaucracy: In principle, it will be under lokpal. CVC will go through complaints first and file status reports with lokpal.

Jan 31, 2013-the centre today amended the Lokpal Bill , delinking it from setting up of Lokayuktas in the states.

Union cabinet accepted 14 of 16 recommendations made by the Rajya Sabha select committee ; which was set up in may last year. This bill was stuck in Rajya Sabha since Dec 2013.
* The probe agency will have to complete its investigation within six months.
* The Lokpal bench will then consider the probe report and ask its prosecution wing to file a charge sheet in a special court, depending on the probe findings.
* One opportunity will be given to a public servant to present his /her views against whom the probe is being conducted.
*Lokpal will not require any sanction from a competent authority of a public servant either at the time of initiating a preliminary inquiry or filing a charge sheet in  court.
*Special courts will have to decide the case within a year.

Appeals against orders of the Lokpal can be filled in the Delhi High Court and the Supreme court.

Expense of the Lokpal:
* All salaries, allowances and pensions payable to all its staff shall be charged from the Consolidated Fund of India.
*Lokpal shall prepare its budget estimates for the nest year during the current financial year to allow the government to have an idea of its expenses and make advance provision for it.

Courtesy means gentle and polite behavior in dealing with people in our day to day life.

It is an act of civility and good manners. Courtesy is a great virtue in a man's life. Courtesy demands one to be modest, tasteful and decent in his talking to and behaving with others.   Courtesy is the gift of treating others with warmth and respect. It means according dignity to people by being considerate, responsive, and kind in our dealings with them.

Courtesy costs nothing but pays a lot in return. A Courteous person is liked and loved by all. This type of men remains very popular among his friends and relatives. Everybody  have willingness to help him in the time of need .These well behaved courteous people are the foundation of good society and nation. But these days the number of these types of people is less. That is why our society is suffering a lot from ill antisocial activities. It is because Courtesy create great atmosphere of living with coherence. Most of the people whom we come across everyday are generally arrogant, impatient and self centered. They neither love other nor are loved by any of them.

The elders , seniors and parent have big role to make our society and nation courteous and well behaved by imparting and building the parameters of good behavior and courtesy in  younger, subordinate and children respectively. Teachers have also great role to model our students on right path of courtesy. The value of  courtesy must be kept at the priority level in the schools. It also has a monitoring process and regulation from government side to create healthy society.

Where to maintain courtesy:

*At the time of receiving relative we should use polite words. We must avoid any negative comments about the forefront ; which will drag him into uneasy state. We should showcase ourselves with cheers and with warm welcome.

*If we are having tea or food and somebody comes during this time, then we must ask him for having same thing which  are being eaten by us at that time.

*We must avoid rudeness while dealing with newcomers in our city. This sends a strong message of high ethics of our city to the newcomers.

*Please, sorry, welcome, right etc words must be used while reporting or dealing any matter that directly connects one with the other. Hajarat Imam Hussain (Raji Allah Tala Anho-RATA) was born in 4 Hijri [ 625 AD] in Madina.

The name of father was Hajarat Ali (RATA) and the name of mother was Hajrat Fatma Johra (RATA). The grand father (NANA) was Hajarat Mohammad Sallallaho-Alehi-Wasallam was the originator of Islam. Hajarat Imam Hussain has got learning of rightest ie he will only support and believe right thing irrespective of any external compulsion , assurance , muscle power or any thing. If the most powerful person is imposing wrong thing in today's time then many of us will go with the powerful man keeping our ethical values aside. This is against the human ethics. But today many of us doing the wrong thing. Because of this maximum problem in the society is persisting.



But the honest, bravery and trustworthiness of Hajarat Imam Hussain  was an example in those time.

Now know the real story what happened in Karbala of Iraq. And the fact of Muharram. After the death of Hajarat Amari Mawia, his son Yajeed announced himself as Caliph (Khaleefa -means  administrator) in Rajjab Hijri 60 [ 680 AD] in undemocratic way. Irrespective of administration job Yajeed was fond of dog, monkey, women, wine and song.  Most of the time he remained drunk. He became wine addicted and ill minded because having wine all the time.

All the people of Arab were acquainted with his bad activity. everybody was condemning but nobody was dare to raise head against him because of his oppression. In this situation Hajarat Imam Hussain  strengthen the inner power of people by telling the truth. He told nobody can declare himself administrator without democracy . He also reminded the administrator's character must  be of high moral values. He told that person like Yajeed can never be accepted as administrator (khaleefa) at any cost. Yajeed allowe wine which is completely prohibited by Mohammad Sallallaho Walehi Wasallam as per instruction of almighty Allah ST. If it happen then what will you answer in front of Allah -Subhan-w- Tala. Hajarat Imam Hussain  condemn every wrong habits and working of Yajeed without any fear. He had highest influence on the people of Arab. Due to this Yajeed has got fear and wanted to take Hajarat Imam Hussain  into his confidence by offering greed of many highest posts and money. He wanted that Hajarat Imam Hussain  must accept him as "Khaleefa". If it happen then no barrier will come in the way of Yajeed and all Arab dwellers will accept him as leader ("Khaleefa"). But if Hajarat Imam Hussain would accept the Yajeed leadership then it meant he would accept corruption, oppression, slavery and injustice. This is central theme of Karbala. It is giving the message to whole mankind that it is better to die with bravery than accepting wrong thing which is against Islamic view  or Quran's message of Almighty Allah Subhan -W-Tala. 

Ultimately Yajeed had 33000 army men and it was not possible to get face this army men by the 100 men of Imam Husain. Yajeed showed the inhuman act of brutality against all member of Imam  Hussain. But Imam Hussain  fired the battle of justice and win the faith of all Arab people. It was the biggest bricks for manifesting the foundation of Islam and strengthening the message of Quran and obeying the commandment of Allah SWT. 

This sacrifice was very highest example for all  that "Never accept corruption, oppression, slavery and injustice "  
It may be that you have no power of money , army, muscle but never lean in front of injustice ; which is one of the core message of Quran-E-Paq .
